From 1 July 2026, DVA can accept liability for 247 listed conditions automatically when a veteran meets the service criteria — without Reasonable Hypothesis, Balance of Probabilities, or working through SOP factors. Presumptive Liability
When a condition is listed in the Presumptive Liability Determination 2026 and the service criteria are met, DVA can accept liability for the condition automatically — no standard of proof, no SOP factors. Athena identifies when a veteran may qualify and lays out exactly what the pathway requires, while keeping the SOP pathway available alongside it.
A faster, parallel pathway
Presumptive liability is a separate head of liability that runs parallel to the SOP pathway. When a condition is listed and the service criteria are met, DVA can accept liability automatically — without the usual standard of proof. The SOP pathway always stays available alongside it, never replaced.
247 conditions, eight service routes
The Presumptive Liability Determination 2026 (F2026L00740) covers 247 conditions across eight routes — specified defence service, secondary conditions, service involving abuse, RAAF Point Cook firefighting, F-111 deseal/reseal, firefighter cancers, occupational diseases, and occupational asthma. Honest three-state checks
Athena evaluates the veteran's service history against every criterion. Gates it can't verify from service records — specific postings, SHOAMP tier, redress payments, chemical exposures — are surfaced as Not Assessable rather than guessed, so you always know what DVA still needs to confirm.
The veteran stays in control
Athena identifies when a veteran may qualify — it never selects the pathway for them. The veteran confirms with a single tap, and the SOP factors stay available either way.
Date-gated to the law
The determination applies only to claims lodged on or after 1 July 2026. Claims lodged earlier see a clear advisory instead of an eligibility check — so no one is misled about qualifying.
Multiple routes, side by side
Conditions with more than one qualifying route — for example peacetime versus warlike service — show as side-by-side panels. Meeting any single route is enough.
Citation-ready exports
GP Letters and DVA exports carry the full presumptive citation — Part, item, and F2026L00740 — plus plain-English service requirements and a liability-basis statement written for the DVA delegate. SOP factor content is omitted from presumptive exports (DVA doesn't need it) but stays available if the veteran switches pathway.
