Quay Elements ("we," "us," or "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we handle your information when you use our software applications (including "Athena" and "Family Health Planner"), website, and services.

We are an Australian company committed to compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

1. Privacy Principles

  • Privacy-first by design: We minimise data collection and prioritise user control.
  • Compliance: We adhere to the Australian Privacy Principles.
  • Data minimisation: We collect only what is strictly necessary for support and security.
  • Security: We protect limited administrative data using industry-standard infrastructure.

2. Information We Collect (General)

Across our business, we collect minimal administrative data:

  • Website Data: Standard log information (IP address, browser type) for security purposes. We also use privacy-respecting, cookieless analytics (Vercel Web Analytics) to understand general usage patterns such as page views and referral sources. This service does not use cookies, does not collect personal data, and does not track individual visitors across sites.
  • Direct Communications: Email addresses and information provided during support requests. Used strictly for assistance.

3. Athena Privacy Architecture

Athena operates entirely on-device. Documents, health and service records, annotations, and AI analysis outputs never leave the user’s device and are not uploaded, stored, or accessible to Quay Elements or Apple in the ordinary operation of the app.

  • Local Processing: All analysis happens directly on your device using CoreML and MLX.
  • No Accounts: Athena requires no account creation or login beyond your Apple ID.
  • Veteran & Advocate Use: Athena may be used by veterans or authorised advocates. We do not verify authority and have no access to user content.

4. Athena Data Handling

Apple Platform Services: Athena is distributed via the Apple App Store. Apple manages payments, subscriptions, and certain diagnostics in accordance with Apple’s own privacy policy. Quay Elements does not receive Apple ID credentials, billing details, or user content as part of these processes.

  • Transaction Data: We receive only anonymous identifiers to validate subscription status.
  • Background Assets: Static resources may download from Apple servers without transmitting user data.

5. What We Do Not Do

To be clear about our privacy stance, Athena does not:

  • Process documents in the cloud or upload data to third-party AI services.
  • Build advertising profiles or track individual users.

Our website uses cookieless, privacy-respecting analytics solely to measure aggregate traffic. No advertising cookies, tracking pixels, or personal identifiers are used anywhere on our site or in our apps.

6. Data Sharing and Disclosure

We do not sell or rent personal information. We disclose information only where required by law or to protect the rights and safety of Quay Elements, our users, or others.

7. International Data Transfers & Service Providers

We use reputable, industry-standard infrastructure providers (e.g., for hosting and email) which may be located outside Australia. These providers process limited administrative data strictly for operational purposes and have no access to Athena app content.

8. Security

We implement industry-standard security measures:

  • On-Device Data: Secured by your device's encryption (FaceID/TouchID).
  • Administrative Data: Protected by secure providers with restricted access. Administrative data is retained only as long as necessary for support or legal obligations and is then deleted or de-identified.

9. Your Rights & Complaints

Under the Privacy Act 1988, you have rights to access and correct your personal information.

  • Access: Request access to your support correspondence via email.
  • Complaints: Email contact@quayelements.com.au. We aim to resolve issues within 30 days. If unsatisfied, you may contact the OAIC.
